Welcome to the website of BEETIFUL Cosmetics GmbH ("BEETIFUL", "we", "us", or "our"). By placing an order for products ("Products") sold on this website, you acknowledge that you have read, understood, and agreed to these Terms and Conditions ("Terms"). These Terms constitute a binding agreement between you and BEETIFUL Cosmetics GmbH, the operator of this website and the contracting party for all sales made through this website, as described in Section 1.

Please read these Terms carefully. If you have any concerns or questions, please contact our customer service team.

We may update these Terms from time to time. The date of the latest update is indicated at the beginning of this page. For each order, the Terms in effect at the time of your order will apply. We recommend that you save a copy of these Terms for your records. If any updates to the Terms significantly affect your order, we will inform you in advance and provide information on how to cancel the contract if you are not satisfied with the changes.

1. About BEETIFUL Cosmetics

This website is operated in Germany, and all sales through this website are concluded with BEETIFUL Cosmetics GmbH, a company registered in Germany.

By choosing to visit this website in Germany to purchase our Products, you agree that any purchase is made in Germany and is subject to these Terms and German law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and conflict of law provisions.

3. Eligibility to Purchase

To place an order on our website, you may do so as a guest or by creating a personal online account. When placing an order and/or creating an account, you must provide certain personal information, including but not limited to your name, address, phone number, and email address. This information must be accurate and complete. If you create an account, you must also create a password. You are responsible for updating your account information promptly. If you fail to update your information, communications sent to your last provided address will be deemed delivered.

We reserve the right to change the conditions for registering an account from time to time. When placing an order, you will also be required to provide payment details. You confirm that the payment details you provide are valid and that you are authorized to use the payment method.

Delivery is limited to the countries described in our Shipping Policy.

Purchasing Products on the website is only permitted for individuals who can legally enter into contracts under German law.

Purchases are limited to end consumers, and orders are accepted only in typical household quantities (generally no more than 5 units of a specific Product).

4. Pricing

We strive to ensure that all content on this website, including Product details, descriptions, and prices, is accurate at the time of publication. However, we will only accept orders if there are no material errors in the description of the Products or their advertised prices.

All prices are inclusive of applicable VAT. The total price of your order will be confirmed at checkout before you pay and place the order. Shipping costs (if applicable) will be added during the ordering process (see our Shipping Policy for details).

Please note that deliveries may be subject to regulatory or legal restrictions and customs duties. Additional taxes, fees, or charges may apply, or customs declarations may be required. We are not responsible for any such charges and cannot provide assistance or advice on these matters. We recommend checking with your local customs authority before placing an order.

The items in your shopping cart reflect the most current price displayed on the Product detail page.

Payment methods include:

  • PayPal: Payment is processed through your PayPal account. Charges are in euros. PayPal's terms and conditions apply. Fees or currency conversions may be charged by PayPal or your bank.
  • Credit/Debit Card: Payments are typically charged in your account's currency. Fees and exchange rates may be subject to your card issuer's terms.
  • Amazon Pay: Payment is processed through your Amazon account. Charges are in euros. Amazon Pay's terms and conditions apply. Fees or currency conversions may be charged by Amazon or your bank.

5. Availability

All Products are subject to availability. Prices listed on our website remain applicable as long as the Products are available or as otherwise indicated on the website. We will inform you as soon as possible if the Products you ordered are unavailable.

6. Online Ordering Process

The online ordering process includes the following steps:

  1. Add desired Products to your shopping cart.
  2. Provide a shipping address.
  3. Choose your preferred shipping method (fees as per our Shipping Policy).
  4. Select your payment method and provide the necessary payment details, including billing address.
  5. You will be prompted to read these Terms carefully.
  6. Before placing your order, you will have the opportunity to review the Products, their prices (including additional charges like shipping fees), and your provided information.
  7. By clicking "Place Order," you confirm your order and accept these Terms. This constitutes a legally binding offer.

7. Order Errors

You can correct errors in your order until you click "Place Order" on the final page of the ordering process.

8. Pre-Orders

If items are offered for pre-order, payment will not be charged until the items are shipped from our warehouse. We aim to ship all pre-ordered items as soon as they become available. Delivery dates may change. You will be notified by email once your order has been shipped. Delivery dates depend on the shipping address and are subject to our Shipping Policy.

9. Backorders

Some items may be available for backorder if they are out of stock and we expect a prompt delivery to our warehouse. If items are offered for backorder, payment will not be charged until the items are shipped from our warehouse. We aim to ship all backordered items as soon as they become available. Delivery dates may change. You will be notified by email once your order has been shipped. Delivery dates depend on the shipping method chosen at the time of order.

10. Order Confirmation and Acceptance

We will notify you as soon as possible by email to confirm receipt of your order and provide your order number. If we are unable to fulfill your order after this confirmation, we will inform you by email or phone. We will confirm acceptance of your order by sending an email confirming the shipment of the Products ("Shipping Confirmation"). A legally binding contract between you and us is formed upon sending this Shipping Confirmation (or, in the unlikely event that no Shipping Confirmation is sent due to processing errors, once we ship the Products to you) ("Contract"). For questions about your order, please contact us at info@beetiful-cosmetics.com. Always include your order number. We reserve the right not to accept orders if a Product you ordered is no longer available, if we identify a Product or pricing error, or if we do not receive authorization for your payment. We reserve the right to reject any offer to purchase Products at any time.

11. Shipping

All our packages require acceptance by a recipient at the delivery address. Therefore, we do not ship to P.O. Boxes.

We ship your Products in accordance with the shipping method you selected. Details on delivery times and costs can be found in our Shipping Policy. References to business days exclude Saturdays, Sundays, and public holidays. Orders to one address may be delivered in one or more shipments; however, only one shipping fee will be charged. Delivery times are estimates.

We are not responsible for delivery delays beyond our control. If our delivery of the Products is delayed due to an event beyond our control, we will inform you as soon as possible and take steps to minimize the delay's impact. Provided we do this, we are not liable for delays caused by the event. If there is a risk of significant delay, you may contact us to cancel the contract. In this case, you will receive a refund for any Products you have paid for but not received.

Upon delivery of the Products to you, we will provide sufficient information to enable you to exercise your legal right of withdrawal, direct an intended objection to the correct recipient, or return or exchange your Products. For more information, see the "Your Right of Withdrawal" section of these Terms.

Depending on security checks, your delivery may be delayed. We apologize in advance for any inconvenience this may cause.

12. Inspection of Ordered Products

Please inspect the Products upon delivery to ensure that all items listed on the delivery note are included. The order is considered accepted unless you notify us otherwise and return the Products in accordance with your right of withdrawal or other legal rights (as described below).

13. Payment

The following payment methods are available: Visa, Mastercard, Maestro, American Express, PayPal, and Amazon Pay. Your account will be charged upon completion of the order.

By using credit or debit card payments, you confirm that you are the rightful owner of the card used. All cardholders are subject to validation checks and authorization by the card issuer. We are not liable for delivery delays or non-delivery if your bank or card issuer refuses or cannot authorize payment.

When using PayPal or Amazon Pay, payment processing is handled through the respective platforms. The terms and conditions of the respective providers apply.

Retention of Title and Transfer of Risk

Legal ownership of all Products remains with us until full payment is received. If a refund is issued, ownership immediately reverts to us. The risk of deterioration or loss of the goods passes to you upon delivery to the carrier.

Electronic Invoicing

You agree to receive your shipping confirmation and invoice electronically at the email address provided during the ordering process or in your online account.

14. Right of Withdrawal

14.1 As a consumer, you have the right to withdraw from a contract without stating a reason from the time of the Shipping Confirmation until 14 days after receiving the last Product in the order. This means that within the relevant period, if you change your mind or decide for any reason that you do not want to receive or keep the Products, you can notify us of your decision to withdraw from the contract and receive a refund (subject to the limitations described in this section).

14.2 The right of withdrawal does not apply to Products that:

(i) are made to your specifications;

(ii) are clearly personalized;

(iii) cannot be returned due to their nature or may deteriorate or expire rapidly;

(iv) are sealed and not suitable for return for health protection or hygiene reasons if unsealed after delivery;

(v) are inseparably mixed with other goods after delivery due to their nature.

14.3 To withdraw from your contract, you must notify us that you have decided to do so. The easiest way to do this is by email to info@beetiful-cosmetics.com. Please include details of your order, including the order number, to help us identify it. Your withdrawal becomes effective on the day you send the email or letter.

14.4 If you withdraw from the contract:

·       We will refund the price you paid for the Products. However, we are allowed by law to reduce your refund to reflect any reduction in the value of the Products if this has been caused by your handling them in a way that would not be permitted in a store. If we refund the price before inspecting the Products and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.

·       We will also refund any delivery costs you paid, up to the value of our least expensive delivery option.

·       You are responsible for the cost of returning the Products to us.

·       Refunds will be processed as soon as possible, and no later than 14 days after we receive the returned Products or proof that they have been sent.

·       Refunds will be made using the original payment method, unless agreed otherwise. If you paid using a gift card, we may issue the refund as a gift card.

·       If you request an exchange, we will process this within 7 business days after receiving the returned Products. A new contract will be formed for the replacement items.

·       If the Products were sent or received before cancellation, they must be returned to us in accordance with our Returns Policy.

15. Warranty

Products supplied by us come with the statutory warranty rights, subject to the following limitations:

·       The warranty only applies to defects that were present at the time of delivery.

·       Cosmetic products may have an expiration or best-before date. No warranty is given for defects occurring after this date.

·       During the statutory warranty period, you may request repair or replacement, unless this is impossible or disproportionate. If not possible, you may request a price reduction or refund, provided the defect is not minor.

·       We are not liable for defects caused by improper storage, use, or natural changes after opening or expiry.

16. Liability

We are responsible for foreseeable losses or damages caused by us breaching these Terms or failing to use reasonable care. A loss or damage is foreseeable if it was an obvious consequence or was contemplated at the time of contract.

We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud, breach of your legal rights, or defective products under the Product Liability Act.

We supply Products for domestic and private use only. You agree not to use the Products for commercial or resale purposes. We are not liable for business losses such as lost profits or opportunities.

17. Additional Liability Provisions

BEETIFUL Cosmetics GmbH, its representatives, employees, and agents shall only be liable for intent and gross negligence unless it concerns a breach of essential contractual obligations or guarantees. We are not liable for misuse of the Products. Liability for lost profits, indirect or consequential damages is excluded unless caused by intent or gross negligence.

Our liability for damages is limited to those that are foreseeable at the time of contract conclusion, except in cases of intent or gross negligence. Liability for injury to life, body, or health remains unaffected.

18. Transfer of Rights

We reserve the right to transfer our rights and obligations under these Terms to another organization. You may only transfer your rights and obligations with our written consent.

19. Governing Law and Jurisdiction

These Terms and any contracts concluded through this website are governed by German law, excluding CISG and conflict of law rules. Jurisdiction lies exclusively with the German courts. Contracts are concluded in German.

20. Digital Gift Cards

The digital gift card from BEETIFUL Cosmetics (“Digital Gift Card”) is not a payment method in the sense of a credit card, debit card, or store credit.

  • Digital Gift Cards can only be purchased and redeemed online at www.beetiful-cosmetics.com.
  • Cards are available in fixed amounts (€25, €50, €100, €200) or with a custom amount chosen by the purchaser.
  • After purchase, the Digital Gift Card is delivered electronically to the email address provided. BEETIFUL Cosmetics is not responsible for delivery issues caused by incorrect email addresses; responsibility lies with the purchaser.
  • Digital Gift Cards are valid for three years from the date of issue.
  • Discount promotions, promotional codes, or vouchers cannot be applied toward the purchase of a Digital Gift Card.
  • The card is only activated after full payment has been received. If payment is declined or reversed, the card's value will be canceled.
  • Digital Gift Cards cannot be used to purchase other Digital Gift Cards.
  • Digital Gift Cards are not redeemable for cash.
  • Any remaining balance will remain on the card and can be used for future purchases. A payout of the remaining balance is not possible. For balance inquiries, contact info@beetiful-cosmetics.com.
  • If your order exceeds the value of the Digital Gift Card, the remaining amount must be paid using another accepted payment method (e.g., credit card, PayPal).
  • Refunds for products purchased with a Digital Gift Card will be returned to the same card. Refunds via other payment methods are subject to our Return Policy.
  • In cases of suspected fraud, manipulation, duplication, or technical damage, we reserve the right to block or refuse a gift card.
  • BEETIFUL Cosmetics does not replace lost, stolen, or deleted Digital Gift Cards.
  • All personal data provided in connection with the purchase or use of a Digital Gift Card (e.g., name, address, email) is used solely for processing purposes. Our Privacy Policy applies.
  • By using the Digital Gift Card, you accept these terms.
  • Digital Gift Cards are issued exclusively in electronic form and sent by email to the address provided during purchase. If free product samples are added to the order, shipping costs may apply.
  • The issuer of the Digital Gift Cards is BEETIFUL Cosmetics GmbH, Löwengasse 27 B, 60385 Frankfurt am Main.

21. 15% Discount for Newsletter Sign-Up

New customers who sign up for the BEETIFUL Cosmetics newsletter for the first time will receive a one-time discount code worth 15% off their first order at www.beetiful-cosmetics.com. The discount code will be sent to the email address provided during registration.

  • The discount code is valid for 30 days from the date of issue.
  • The code is non-transferable, may only be used once per person, and is valid only for first-time orders.
  • The discount does not apply to already discounted items, digital gift cards, or shipping costs.
  • The discount cannot be combined with other promotional codes or offers.
  • A cash payout or retroactive application of the discount is not possible.
  • BEETIFUL Cosmetics reserves the right to modify or end this promotion at any time or cancel orders in the case of misuse or suspicious activity.

22. Refer a Friend

New customers receive a 10% discount on their first order when using your personal referral link or code. Once the order has been successfully completed, you will receive a personal 10% discount code for your next order as a thank you.

  • The discount code is valid for 30 days, non-transferable, and cannot be combined with other promotions.
  • The discount does not apply to discounted items, digital gift cards, or shipping fees.
  • A cash payout is not possible.
  • BEETIFUL Cosmetics reserves the right to change or end the referral program at any time or take action in cases of suspected misuse.
